"Mark Madoff took his life today," said Martin Flumenbaum, lawyer Mark Madoff said in a statement Saturday. "This is a terrible and unnecessary tragedy."
A city official said the first notification, through 911, was in 7:27.18, on the morning of Saturday, and the call was for a "possible suicide." The call came from a fourth floor, private house at 158 Mercer Street, a 13-story building on the edge of Soho.
Deputy Commissioner Paul J. Browne said the body had been discovered by Father Mark Madoff in the law. "He arrived this morning," said Browne.
Browne said Mark Madoff "child 2 years old, slept in an adjoining room."
Browne added: ". Apparently, the son-in-law had indicated that a person should check on the child, had a notice to the wife who must check in the child"
Browne could not say what time mark Madoff fact that the notice or say whether investigators believe was part of a plan.
Browne said the body was hanging from his neck, a pipe in the ceiling of the living room. A black dog leash had been used, he said.
Since the arrest of Bernard Madoff, all immediate family members have undergone a battery of civil lawsuits originally filed by victims of the Ponzi scheme and later by the receiver in bankruptcy to pursue the assets of the victims.
Demand Manager, introduced last year, sought to recover approximately $ 200 million that the family received in salaries, bonuses, expense account payments and profits in their own investment accounts in signing Madoff. More recently, the trustee, Irving H. Picard, filed a new lawsuit in London, named Mark Madoff, 46, along with other directors and executives of the subsidiary there Madoff, Madoff Securities International, Ltd. was transferred to the recovery of profits and payments of defendants received from that subsidiary, on whose board Mark Madoff served.
These lawsuits are pending, and not necessarily derailed by the death of Mark Madoff. Typically, the litigation would continue against the estate of any deceased defendant, as was the case when Jeffry Picower, one of the largest investors Bernie Madoff, died in October 2009.
Madoff had worked at the brokerage firm of his father since graduating from the University of Michigan in 1987. Several children's friends oldest Roslyn, New York, Madoff has invested and lost their savings in the fraud. This destroyed the relationship and the pain caused great brand, said a person close to the family who requested anonymity.
The steps leading to the arrest of his father started when he and his brother, Andrew, against his father about his plans to distribute hundreds of millions of dollars in bonuses to employees months ahead of schedule.
That led to a private conversation on December 10, 2008, in which Bernard Madoff told his sons that his whole life - all the wealth and success of the family seemed to possess - is based on a lie. His money management business, apparently was not lucrative but a huge Ponzi scheme, and crumbled under relentless pressure from the financial crisis of late 2008.
Mark and his brother immediately consult an attorney and were advised that they should inform his father's confession to police. They did so, and the next morning her father was arrested at his Manhattan penthouse.
The public anger about crime impressive - Bernard Madoff, whose loss is estimated at $ 50 billion - not limited to its mastermind. Mark Madoff, her mother and brother were the subject of constant media speculation. Some links repeatedly predicted his imminent arrest, and speculated that many items had been involved in the murder of his father, or at least were aware of it.
But the charges were not filed against any member of the immediate family and his lawyer has said publicly that neither Mark nor his brother had been notified by prosecutors that were the subject of a criminal investigation.
A person close to Mark Madoff said he had been increasingly anxious as the anniversary of the arrest of his father came, and he had been disturbed at some recent news coverage speculation that criminal charges against him and his brother were being probable.
Mr. Flumenbaum, in his statement, Marcos called "an innocent victim of the monstrous crime of his father, who succumbed to two years of relentless pressure from false accusations and innuendo."
